Frequently Asked Questions

Most Common Bakersfield Lemon Law Questions

We have complied the most common questions people ask us about the California Lemon Law.

What is Lemon Law?

A lemon is generally a car that’s under warranty, with dangerous issues that aren’t able to be repaired.

What laws protect me if my car is a lemon?

The federal government and each individual state have “lemon-laws”. The lemon law in California is one of the toughest and best for the consumer. You assume that your new car is safe and won’t have serious problems. By selling you the car, the manufacturer agrees to that. Unfortunately, some cars have defects that can’t be fixed. These laws are meant to give the consumer a way out of this never-ending cycle of auto repairs. If we can prove your case under lemon law, the manufacturer will buy your car, pay you cash, or replace your car.

Does California lemon law apply to cars only?

The Song-Beverly Consumer Warranty Act is the lemon law in California, and applies to all consumer goods with a warranty. The Magnuson-Moss Federal Warranty Act is the federal law that protects consumers of all types of products under written warranty, sometimes called the “Federal Lemon Law.”

Does my car have to be new to qualify for California lemon law?

Your car does not have to be new to qualify, as California’s lemon law covers all car under warranty. Your car could be under several warranties:

  • Manufacturer’s warranty – Often good for at least 18,000 miles or 18 months.
  • Powertrain warranty – Even if the owner changes, covers the car for up to 10 years
  • Dealer’s written warranty – Used cars purchased from dealerships will have a buyer’s guide with “warranty” box chosen if this applies
  • Certified pre-owned (CPO) – If applicable
How long does the lemon law process take?

The length of time to settle your claim depends on your situation. Some factors include the type of issues your car is facing, the repair attempts made, the repair history, the manufacturer, the status of your claim when you first contacted us, and the laws that apply to you best.

We will settle your claim as soon as possible. We have much experience working with the legal departments at auto manufacturers, which helps us move more efficiently through the claim process.

What if the dealer tells me my car doesn’t qualify?

The dealers are trained in their cars, not the law. They are not legally able to give you legal advice. You may not qualify under California lemon law, but may still have a claim under other laws that protect consumers. Naturally, the dealer wants to make you happy by fixing your car. They are not the most qualified to give you legal advice. We are law experts. We are the best choice to determine if your car qualifies to receive legal relief.

Did I need to purchase my car in California?

Many different state and federal laws could apply to your situation. No matter where you buy your car or where you live, you may be entitled to a claim under Federal lemon law. Call us with the details and we will determine which law applies best to you!

How much can I expect to recover?

The manufacturer may have to buy the car back from you, minus the amount you were able to use your car. They may need to replace the car for you. You may qualify for other damages as well. The specific terms of your claim will have an impact of what you can recover. We have experience in California lemon law and other related laws and working with the manufacturers on these claims. Let us help you recover as much as possible!

Can I do this on my own or do I need an attorney?

You have the right to file a claim without an attorney. However, you don’t have the experience we do in lemon law. You may not realize how much you’re entitled to. The manufacturer will assume you’re not trained in the law, which leaves you vulnerable. Our experience as Bakersfield lemon law attorneys allows us to prepare the claim, file the claim, and handle the manufacturers. You don’t have to pay us a thing! When your settlement is successful, the manufacturer pays us. What do you have to lose?
