Does California lemon law apply to cars only?
The Song-Beverly Consumer Warranty Act is the lemon law in California, and applies to all consumer goods with a warranty. The Magnuson-Moss Federal Warranty Act is the federal law that protects consumers of all types of products under written warranty, sometimes called the “Federal Lemon Law.”
Does my car have to be new to qualify for California lemon law?
Your car does not have to be new to qualify, as California’s lemon law covers all car under warranty. Your car could be under several warranties:
- Manufacturer’s warranty – Often good for at least 18,000 miles or 18 months.
- Powertrain warranty – Even if the owner changes, covers the car for up to 10 years
- Dealer’s written warranty – Used cars purchased from dealerships will have a buyer’s guide with “warranty” box chosen if this applies
- Certified pre-owned (CPO) – If applicable
How long does the lemon law process take?
